Terms of Service

1. Agreement to Terms

By creating an account, accessing, or using the BlazeProps platform ("Service"), you ("Client," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. By checking the "I agree" box during registration, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy.

2. Service Description

BlazeProps provides automated trading software ("Bot") that you configure and deploy on your own third-party prop firm evaluation and funded accounts via webhook integrations. The Service includes guided setup assistance, a real-time dashboard, and ongoing strategy updates. You maintain full control over activation, deactivation, and configuration at all times.

The Service is a software tool only. BlazeProps is not a broker, investment advisor, fund manager, or financial institution. We do not hold, manage, or have access to your trading capital. All trades execute on your third-party accounts via webhook signals.

3. No Guarantee of Performance

PAST PERFORMANCE IS NOT INDICATIVE OF FUTURE RESULTS. Trading futures involves substantial risk of loss and is not suitable for all individuals. You acknowledge that:

• No trading system can guarantee profits or prevent losses.
• The Bot may experience periods of drawdown, consecutive losses, or underperformance.
• Market conditions change and past results do not guarantee future returns.
• You may lose some or all of the capital in your trading account(s).
• Any performance data, backtests, or trade history shown is for informational purposes only and does not constitute a promise of future results.

4. Plans and Fees

The Service is offered on the following plans, all in USD, and all granting the same access and functionality:

• Monthly: $250 per month, billed in advance and renewing automatically each month until cancelled.
• Annual: $2,000 per year, billed in advance and renewing automatically each year until cancelled.
• Lifetime: $5,000 as a single one-time payment, with no recurring charge. See Section 6.

There is no setup fee. All fees are charged in advance and cover access to the Service, strategy updates, and support for the applicable period. We may change our prices at any time; a price change will not affect the fee for a subscription period you have already paid for, and we will give existing subscribers reasonable notice before a renewal at a new price.

Third-party costs are separate and are not paid to us. Prop firm evaluation fees, reset fees, funded account fees, and any broker or platform charges are your responsibility and are paid directly to those providers.

5. Payment Processing

Payments are processed by Whop, our third-party payment provider, and are subject to Whop's own terms and policies in addition to these Terms. Checkout takes place on Whop's hosted pages.

BlazeProps never receives or stores your full card details. Your payment method is held by Whop. You can view receipts, update your payment method, and cancel a recurring plan from your Whop account at any time, in addition to the controls in your BlazeProps dashboard.

6. Lifetime Access

The Lifetime plan is a single payment granting access for as long as BlazeProps continues to operate the Service. You acknowledge and agree that:

• "Lifetime" means the operational lifetime of the Service, not your own lifetime, and does not create a perpetual or indefinite obligation on BlazeProps to operate the Service.
• Lifetime access is for a single user, is personal to you, and may not be sold, transferred, shared, or assigned.
• Lifetime access includes updates and improvements to the Service as they are generally released to all customers. It does not include separately marketed products, nor any third-party costs described in Section 4.
• If we permanently discontinue the Service, we will give Lifetime customers at least thirty (30) days' written notice by email. Discontinuation does not entitle you to a refund except where required by applicable law.
• Lifetime access may be terminated for breach of these Terms in the same way as any other plan, as set out in Section 11.

7. Refunds

All sales are final and all fees are non-refundable, except where a refund is required by applicable law.

By purchasing the Service, you acknowledge and agree that:

• Fees are not refundable on the basis of dissatisfaction with results, trading losses, prop firm account violations or disqualifications, or change of mind.
• Access is delivered immediately on activation, and no partial or pro-rata refund is given for unused days in a period you have already paid for.
• Cancelling a recurring plan stops future charges; it does not refund charges already made.

Nothing in these Terms limits any statutory or consumer-protection right you have that cannot be waived under the law of your jurisdiction. Where such a right applies, it prevails over this Section. Refunds that we do issue, or that Whop issues under its own policies, are processed to the original payment method.

8. Chargebacks and Disputes

Please contact us before filing a payment dispute. Most billing problems are resolved quickly by email at support@blazeprops.com, and we will work with you in good faith.

If a chargeback or payment dispute is filed against a transaction, we may suspend access to the Service while the dispute is being resolved, in order to prevent continued use of a service that is not being paid for. If a dispute is resolved in our favour, or is determined to be unfounded or made in breach of these Terms, we may terminate your account and, to the extent permitted by applicable law, recover the disputed amount together with any fees and reasonable costs we incur.

9. Disclaimer of Liability

To the fullest extent permitted by applicable law:

• BlazeProps shall NOT be liable for any trading losses, missed trades, slippage, execution failures, or any financial harm arising from use of the Service.
• BlazeProps shall NOT be liable for any prop firm account violations, disqualifications, or breaches caused by market conditions, technical issues, third-party platform failures, or any other reason.
• BlazeProps shall NOT be liable for data feed errors, webhook delivery failures, platform outages, internet connectivity issues, or any technical issue beyond our reasonable control.
• BlazeProps shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits.
• Our total aggregate liability arising out of or relating to the Service shall not exceed the total amount you actually paid to BlazeProps in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties. Where that is the case, the exclusions and limitations in this Section apply only to the extent permitted by law.

10. Self-Directed Use & Assumption of Risk

You are a self-directed user of this software. BlazeProps does not manage your accounts, make trading decisions on your behalf, or act as your agent in any capacity. You independently choose to configure and activate the software on your own accounts. You acknowledge and agree that:

• Futures trading is inherently risky and may result in the loss of your entire account balance.
• You are solely responsible for any and all trading activity on your accounts, including activity executed by the Bot that you configured and activated.
• You have the ability and sole responsibility to disable, pause, or reconfigure the Bot at any time via your dashboard.
• You are trading with capital you can afford to lose.
• You understand and accept the rules of any prop firm whose accounts you connect to the Service.
• BlazeProps is a software provider, not an investment advisor, broker, or money manager.
• No fiduciary relationship exists between you and BlazeProps.

11. Cancellation and Termination

You may cancel a recurring plan at any time from the Billing page in your dashboard, or from your Whop account. Cancellation takes effect at the end of your current billing period:

• You will not be charged again.
• You keep full access, and the Bot keeps running on your connected accounts, until the end of the period you have already paid for.
• At the end of that period, webhook connections are severed, the Bot stops trading on your accounts, and dashboard access is revoked.
• No refund is issued for the remainder of the period, as set out in Section 7.

The Lifetime plan does not renew and so has nothing to cancel. You may stop using the Service at any time.

We may suspend or terminate your account for breach of these Terms, for non-payment, for abuse of the Service or our staff, or where required by law. Where we terminate without cause, we will refund any prepaid fee covering the period after termination.

12. Intellectual Property

All strategies, algorithms, software, and proprietary systems are the exclusive property of BlazeProps. You agree not to reverse-engineer, copy, redistribute, resell, or share any aspect of the Service, including but not limited to: trading logic, signal methodology, dashboard code, or API endpoints.

13. Indemnification

You agree to indemnify, defend, and hold harmless BlazeProps, its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, costs, or expenses (including attorney's fees) arising from your use of the Service, violation of these Terms, or violation of any third-party rights.

14. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Florida. You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this Section prevents either party from seeking relief in a small-claims court where the claim qualifies, or limits any non-waivable right you have to bring a claim in your local jurisdiction.

15. Modifications

We reserve the right to modify these Terms at any time. Changes are effective upon posting to the website, except that any change to fees or to your cancellation rights will apply from your next renewal and not retroactively. Continued use of the Service after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be limited or removed to the minimum extent necessary and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and any order forms or payment confirmations, constitute the entire agreement between you and BlazeProps regarding the Service.
